Terms of service

1. Who provides the service

AlmaSuite (https://almasuite.coach) is a service of CODELABS STUDIO, S.L., Tax ID (CIF) B88708797, registered office at Pasaje Federico García Lorca, 6, 3º E, 29130 Alhaurín de la Torre (Málaga), España, entered in the Companies Registry of Málaga (Registro Mercantil de Málaga), sheet MA-198508, entry 1. 2. The service

AlmaSuite is a software platform for coaching, mindfulness and wellbeing professionals. Each professional creates their space, with their brand and, optionally, their domain, and offers their clients courses, daily check-ins, messaging, video sessions and artificial intelligence tools from it. AlmaSuite does not provide coaching or health services: each professional provides them and is solely responsible for them and for the relationship with their clients.

3. Accounts

• The professional must be of legal age and provide accurate data. They keep their credentials safe and are responsible for the use of their account and their team's accounts.
• Clients join by invitation or sign-up in the professional's space; their data is managed by the professional as controller.

4. Plans and price

Plans, prices and what they include are those published on the pricing page when you subscribe. If a plan is paid, the price and billing period are shown before you subscribe and nothing is charged without your express acceptance. You can cancel the renewal at any time; the plan stays active until the end of the paid period.

5. Obligations of the professional

• Publish only lawful content they hold the rights to.
• Inform their clients about the processing of their data and obtain the necessary consents, in particular explicit consent for wellbeing check-ins.
• Not present the service as medical or psychological treatment or use artificial intelligence to diagnose.

Our processing of clients' data, as processor, is governed by the article 28 GDPR clauses, which form part of these terms.

6. Content generated with artificial intelligence

Summaries, analyses, texts and avatar videos generated with artificial intelligence may contain errors. The professional must review them before using them with their clients.

7. Intellectual property

The software and the AlmaSuite brand belong to CODELABS STUDIO, S.L.. The professional keeps ownership of their content and grants us the licence needed to host it and show it to their clients while they use the service.

8. Suspension and termination

You can close your account whenever you want. We may suspend an account that breaches these terms, giving the reason unless urgency or the law prevents it. On termination, the professional can ask for an export of their data and their clients' data before it is deleted.

9. Liability

CODELABS STUDIO, S.L. is liable for damage it causes through wilful misconduct or negligence. Towards professionals and businesses, and to the extent permitted by law, its liability is limited to the amount paid in the previous twelve months and excludes loss of profit and indirect damage. Nothing in this section limits the rights that the law grants to consumers.

10. Governing law and jurisdiction

These texts are governed by Spanish law. If you contract or use the service as a business or professional, the parties submit, expressly waiving any other jurisdiction that may apply, to the Courts and Tribunals of Málaga (Spain). If you are a consumer, the competent courts are those determined by the mandatory consumer protection legislation (generally, those of your place of residence), and the courts of Málaga only where the law allows it.
